A man was indicted on a negligent homicide charge after lab results showed he tested positive for THC after a crash that resulted in the death of a motorcyclist on April 28.

Pablo Alejandro Reyes, 32, was arrested Monday in connection with the death of 43-year-old Benjamin Barth, according to the Pinal County Sheriff’s Office.

THC is the main active ingredient in marijuana responsible for its psychological effects.

“This is another reminder that driving under the influence of alcohol or drugs is dangerous and against the law,” Sheriff Mark Lamb said in a news release. “A life was taken because of the choices made by the driver that day.”

Reyes attempted to pass cars at a high speed in a “no passing” area near McCartney and Overfield roads near Casa Grande. He did not see the oncoming motorcyclist until it was too late, officials said.

Barth swerved to avoid Reyes. He crashed his motorcycle and died instantly, the Sheriff’s Office said.
