Two Alva residents are facing felony charges involving an investigation from December 2016.
Charges were filed April 20 against Keisha Marie Fischer, 36, and James Wallace Weinhoffer, 52, for possession of controlled substance (marijuana) within 10,000 feet of a school. This crime is punishable by imprisonment for four to 20 years and a fine of not more than $10,000.
According to court documents, on Dec. 26, 2016, about 5:45 p.m. Alva Police Officers John Caviness and Keith Dale went to 118 Locust to speak to Fischer and Weinhoffer about drug activity at their residence. They knocked on the door and went inside to talk.
When Dale asked if they had any illegal substances, both said no. As they continued to speak, Weinhoffer retrieved two homemade brass metal pipes from his pocket and placed them on a chair next to Dale. He examined them and found they contained burnt marijuana. He asked them if they had any more drug paraphernalia or illegal substances inside, and they again said no.
Dale asked if they would allow a search of their residence, and they said yes. While the officers searched, Weinhoffer and Fischer said they had a quantity of marijuana hidden in the living room. They retrieved a plastic baggie containing marijuana. Weinhoffer said he bought the marijuana to “get them through the week.”
The pipes and marijuana were collected before the officer left the residence. A search shows that the address is 340 feet from a licensed daycare, 556 from the Lutheran Early Child Education Center and 908 feet from Longfellow Elementary School.
